Implementation of the Judgments of European Court of Human Rights on Property Rights against Azerbaijan Policy Paper

The research team of the Institute for Democratic Initiatives (IDI) has prepared the research paper on the judgments of the European Court of Human Rights on property rights against Azerbaijan and their implementation status.

The research document is based on the results of the findings received from lawyers and citizens on the judgments of the European Court regarding property rights.

As a result of the study of 37 judgments during the preparation period of the research paper, it was found out that the compensations in 33 decisions were paid by Azerbaijan Republic. However, 29 judgments concerning the implementation of the judgments of the domestic courts have not been enforced by Azerbaijan Republic yet.

As it turns out, the judgments of the European Court of Human Rights on property rights are analyzed in the research paper. This section of the research document contains gaps and recommendations based on the monitoring of the legislation.

The research paper also touches the legal conditions regarding the property rights and judgments of European Court of Human Rights in the legal system of Azerbaijan and International Law, the legal nature of the judgments of European Court of Human Rights and the legal framework of the mechanisms of their internal implementation.

This research paper has great importance because it is an only document which covers the judgments of the European Court of Human Rights on property rights against Azerbaijan and their implementation status.
