The Analysis of The Legislation regarding Administrative Detentions and on The Status of Ill-treatment in Azerbaijan- Policy Paper

The research group of the Institute for Democratic Initiatives has prepared a report Statistics and Comparative Analysis of politically motivated administrative detentions and ill-treatment in Azerbaijan in 2018.

This report is based on the monitoring of the report by Election Monitoring and Democracy Studies Center (EMDS) between 1 January and 31 December and questionnaire by the State Statistical Committee of the Republic of Azerbaijan, as well as the reports of international organizations between 2011-2018.

According to 3 months monitoring,  78 out of 8, 449 administrative detentions have been politically motivated. It can be deducted from the report that despite the amendments in Code of Administrative.

Offences, administrative detentions have increased more than double.

The concept of administrative detention, its place in both local and international code and documents that regulates  have been touched in this document.

To determine international opinion about administrative detention and ill-treatment between 2011-2018, monitoring of the reports by European Committee for the Prevention of Torture, US Department of State, Amnesty International and "Human Rights Watch” has been conducted as well. 

Decisions on this issue by European Court on Human Rights have also been analyzed and added to the report. For determining ill-treatment in administrative detentions and conditions of the detention centers, 15 people were also interviewed. 

According to this monitoring, recommendations have been given on ill-treatment in administrative detentions and conditions of the detention centers.

The given document ("Statistics and Comparative Analysis of administrative detentions and ill-treatment in Azerbaijan in 2018”) has a great importance as it is the only document that covers the situation in 2018 broadly and determines the tendency between 2011-2018.
